1.1 Information You Provide
When you use the App, you may provide certain information directly, including:
- Support communications (for example, emails you send to [email protected]).
- Payment and subscription details are handled by Apple — we do not receive your full payment card details. See Subscriptions below.
1.2 Automatically Collected Information
The App may automatically collect technical and usage information such as device model, iOS version, app version, crash logs, and analytics to help improve the App. This data is collected in aggregated and anonymized form where possible.
1.3 Data Stored in iCloud
The App uses Apple iCloud to store user data (for example: your scan history, saved scans, preferences, and related metadata). The data is stored in your private iCloud account and synced across your devices signed in with the same Apple ID.
We do not have access to your iCloud password. Data stored in iCloud is subject to Apple’s privacy policies and terms. For more information about how Apple handles iCloud data, please see Apple’s privacy documentation.
1.4 Photo Scanning with Google Gemini
When you scan a gemstone photo using the App, the image may be securely transmitted to Google Gemini services for analysis and identification. These images are processed only for the purpose of providing scan results and are not used by Penguin for any other purpose. Processing is subject to Google’s privacy policy and terms of service. We encourage you to review Google’s privacy policy to understand how they handle data.
2. How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve the App and its features (including syncing via iCloud).
- Process gemstone scans via Google Gemini services and deliver identification results.
- Process and manage subscriptions and entitlements.
- Respond to your support requests and communicate important notices.
- Analyze usage trends and diagnose technical issues.
3. Subscriptions & Payments
The App offers subscription packages that grant a limited number of gemstone scans or other premium features. Subscriptions and in-app purchases are processed by Apple through the App Store. By purchasing a subscription you agree to Apple’s terms and pricing policies.
We do not receive or store your payment card information. Any billing, refund, or purchase disputes should be handled through your Apple ID / App Store account. For information on managing subscriptions, see Apple’s documentation on subscriptions.
4. Sharing & Disclosure
We do not sell your personal information. We may disclose information in the following limited circumstances:
- Service providers: We may use third-party services to support the App (for example, analytics, crash reporting, or Google Gemini for image analysis).
- Legal reasons: We may disclose information in response to lawful requests by public authorities or to comply with legal obligations.
- Business transfers: If Penguin merges with or is acquired, user data may be transferred as part of that transaction. We will notify affected users where required by law.
5. Analytics and Crash Reporting
We may use analytics and crash reporting tools to monitor and improve the App. These tools collect information such as how you use the App and when it crashes. Where possible we use aggregated or pseudonymized data.
6. Security
We take reasonable measures to protect the information we handle. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
7. Data Retention
We retain the data we collect for as long as necessary to provide the App and its features, comply with legal obligations, resolve disputes, and enforce agreements. If you delete the App your iCloud-stored data may be removed from your iCloud account according to Apple’s retention rules. Images sent to Google Gemini are processed only for scan purposes and are not retained by Penguin.
8. Your Rights & Choices
Depending on your location and device settings, you may have certain rights regarding your data, such as the ability to access, correct, or delete information stored in iCloud or within the App. You can also manage your subscriptions through your App Store account settings.
